Andover's Zoning Board of Appeals (ZBA) meets Thursday, Nov. 5, with a proposed 40-unit condominium and a long-disputed contractor's yard topping the agenda.

The board has nine cases to consider, starting at 6:30 p.m. in the Select Board Meeting Room at 36 Bartlet St., according to the posted agenda. The meeting will be live-streamed on Andover46.com.

40-unit condo seeks continuance

Trailside Andover Development LLC is seeking a comprehensive permit under M.G.L. Chapter 40B to build 40 ownership condominium homes at 84 and 88 Andover St. The case first appeared as a continued hearing on the ZBA's Oct. 1 agenda.

The Nov. 5 agenda lists a request to continue the hearing to Dec. 3, 2026. Details about the project's site plan, affordable-unit count and building design are not available in public agenda documents.

Contractor's yard back before the board

Forever Endeavor, the LLC tied to property owner Matthew Strong of Andover, is listed for a new hearing on a special permit to operate a contractor's yard at 1323 South St. The application also seeks a modification of a prior ZBA decision, Z-25-32, or relief as a party aggrieved of conditions in that decision.

The site has drawn complaints for years. The ZBA denied a special permit for the yard in January 2022 after Andover Building Commissioner Chris Clemente determined Strong had created the yard without permits and issued a cease-and-desist order, as reported by the Tewksbury Town Crier. The board voted unanimously to deny the permit and uphold the cease-and-desist, the Town Crier reported.

Strong appealed to court. In October 2023, the ZBA again denied a special permit for the site, sending the matter back to litigation, as reported by the Tewksbury Carnation.

The property sits in Andover but is accessible only via Tewksbury's South Street. Tewksbury residents and officials, including Tewksbury Select Board member James Mackey, have attended past hearings to voice concerns about noise, heavy-truck traffic and environmental issues, according to ZBA meeting minutes.

At an October 2025 hearing, neighbors described noise, early-morning disturbances and what they called inadequate buffer enforcement, according to ZBA minutes. Attorney Peter Caruso, representing Strong, told the board the owners had planted trees, installed a gate and removed problematic tenants, the minutes show. The board voted 5-0 to continue the case and scheduled site visits.

The new Nov. 5 application carries a different case number, ZBA-26-37, than the prior proceeding, ZBA-25-32. What the board decided on the earlier case after December 2025 is not reflected in the available agenda documents.

Other new hearings

The board will also hear five additional new cases:

  • 55 Harold Parker Road: Melissa Cowan seeks a special permit to keep and board horses, and to offer riding lessons, training or breeding for a fee. She also seeks approval for an accessory structure larger than the main building.
  • 26 Hemlock Road: Kevin Nazzaro requests a variance for a new deck that would encroach into the side-yard setback.
  • 174 Beacon St.: Johanna Cruz requests a variance for a porch that would encroach into the front-yard setback.
  • 7-9 Shipman Road: Valerie Voscoe seeks renewal of a special permit.
  • 22 Haggetts Pond Road: Everett L. Belisle seeks a variance for a new dwelling and land-disturbing activities within Priority Zone 1 of the Watershed Protection Overlay District.

Deliberations and board elections

The board will continue deliberations on two pending cases: a shed placement at 3 Torr St. filed by Jared and Sarah Foley, and a family dwelling unit at 14 Russett Lane filed by Stephen and Ruth Zaimes.

The ZBA will also elect a chair and clerk. As of January 2026 meeting minutes, Elizabeth Oltman served as chair and Lisa Rechisky as clerk.
